Put a STOP to Parking Poaching!

Parking in sectional title schemes is almost always a problem. There just isn’t enough of it.

You may well have your own parking bay, but that doesn’t mean it is always available for you. If you have a problem with other owners and occupiers parking in your spot, we know its blood pressure increasing stuff. Read on for our suggestions* on how to guard your bay.

  • Make sure the bay is clearly marked with your section number or name on it. You will need to get the prior written consent of the trustees before placing a sign on the parking bay.
  • Place a lockable fold-down bollard on the bay that effectively blocks the bay off when your car is not on it. Again, you will need the prior written consent of the trustees to do this but note that in this instance they are not entitled to unreasonably withhold their consent.

  • If you can rally the support of enough owners, pass a rule that provides for fining owners for parking transgressions. This can be passed as a conduct rule, but because of the common law notions of fairness (eg. let both sides be heard etc.) we recommend that it is drafted by an attorney well versed in sectional title, to make sure it is enforceable.
  • Arbitration. Really a last resort if the same person continually parks in your bay and you have tried all other channels. Although the price may not make it worthwhile.
  • And finally a fun one, which we don’t recommend but laughed at when we heard it… Park them in and when they come to ask you to move your car so they can get out, refuse to do so until they have paid you ‘rent’ for parking in your space. True story.

Personally, I’d go with the first two options.
