Paddocks has decided to use its Facebook page as a public Q&A forum. The public can ask and answer questions related to sectional title and we hope that this sharing of knowledge will benefit and educate persons professionally and personally involved in sectional titles.

Paddocks will choose a ‘question of the day’ from Monday to Friday and one of our sectional title specialists will provide a professional answer.     We have a problem with the body corporate, we live next to one of the complex trustees in the complex where she always complains about everything, we where given the rules of the complex and we are living according to the rules but now this trustee is giving us problems adding her own rules, wanting us to live her lifestyle, doesn’t want our kids to play, when we have visitors she will lie and phone our landlord saying that we are making an excessive noise, she gossips about us and try to turn people at the complex against us, when she wants someone out of the complex that’s what she does, she once came to us when we started living in the complex and asked us to write a letter of some tenants that where living in a unit below us , and we asked why should we write a letter and complain about people that we don’t have a problem with, after that those tenants where chased out by the landlord and she started complaining about us, lying, and the body corporate does not even investigate when she complains about something, they are so quick to send a letter to us, but when we complain about the things she does, they defend her, sometimes don’t even reply to our e-mails. We cant live peacefully there and we don’t know where to go or what to do. She does as she pleases in that complex and she gossips, we cant even speak or mix English when we have conversations there because we once caught her listening on our kitchen window.

    If an interior wall is damaged due to exterior water, either rain or damp, is it the responsibility of the owner, insurance or body corporate to repair the damage.

    Hi there

    I need help/advice. I bought a house in a full title complex.. In front of my house/yard is common garden/park. The trustees have decided, on their own, to make visitors parking where the park was and it influences my entire homes privacy and view. I ask for permission for a wall but they declined.. I also asked for them to reconsider the parking area but they also declined.

    What are my rights as an owner? Do I just have to accept the parking area here? Can they just change the park from garden to parking? And without my knowledge as it inpacts my home directly!
    Do I have a say in the matter as it influences not only my privacy but also my homes value negatively!

    Please help!

    How is the cost of a consolidation certificate calculated.
    Case: flats have been illegally combined. estate ( diseased estate) can only sell if flats are consolidated. As an architect I am offering to take the flats that have been illegally combined and reinstate the original sections. However – by saving the estate the consolidation, I want to knock off a huge amount from the asking price , since what is on offer is not in any way as per original l intended use

    Hi

    Can I as a resident withdraw from the body corporate insurance policy as the insurers are not helpful at all and dragging their feet when we lodge claims

    I am frustrated at the end of day

    I want to get my own policy independent from body corporate insurance

    I am a owner in a body corporate

    Am I allowed to ask to see financial records
    Insurance policies,claim history and repair invoices. Also can I question the quality of services of our managing agent and insurers
    And remove them by special resolution before their term is up

    Hi, we live in a sectional title complex and would like to know our rights regarding the playing of musical instruments (piano, guitar). The next-door neighbour is trying to limit our daily playing time to 30 minutes, and objects to the ‘noise’ of the piano especially. We feel this is unreasonable. Your advice would be highly appreciated.

    Hi, I stay in a complex where there is nothing happening, i have been staying therefor 5 years now and we have never had an AGM, we have meetings once in a while but nothing is documented, what happened now is that they identified units which they suspected that their electricity was bridged and got someone to check and put a seal on their meters. It was decided that all units should be sealed at a cost of R350.00 per unit.

    I asked them not to put a seal on my unis as i wont afford it and my electricity is not bridged, i suggested that there is someone who can do that for them at a cheaper rate but i was ignored;, and when i received my statement i realized that i was billed extra R350.00 which i deducted when i do my payment and my electricity connection was cut off. I want to know if is there anything I could do as i want to take this matter forward, i feel like this complex is being run as if they are running their own households.

    Hi, I live in a sectional title complex, that 5 owners went to court to get rid of the previous managing agent, the court appointed an administrator, and they appointed a manager agent, that was way back in 2010, to date, we have had no AGM, when we enquire we are told it is not necessary, as everything is under control
    I am an owner and would like to know, as it seems we have no rights since they took over, they raised the levies by 108% in 2010, in additional 2 special levies of R305 over 3 years, and R600 over a year,

    We are 4 Sectional Title Complexes sharing one communal Entrance. This paved road leads into an atrium where the 4 entrance gates are. The gardens surrounding the gates are kept by each complex.

    The paved road is in dire shape and needs to be replaced (which is already about 18 years old). Meetings have been held, quotes received and the price which each complex had to contribute was R25000-00. One complex now refuses to pay.

    Are they obliged by law to contribute?

    Your advise will be highly appreciated.
